General Conditions for Warranty Claims

  • (a) Warranty claims must be filed within the Warranty Period.
  • (b) Warranty claims may only be made by:
    • (i) The original end customer (as named in the certificate of guarantee or invoice).
    • (ii) Any subsequent owner of the PV Modules upon proof of succession or transfer from the original end customer.
  • (c) When PV Modules are used on a mobile platform (e.g., a vehicle), the Warranty Period is limited to 12 years.
  • (d) In cases of PV Module replacement, the replaced PV Module becomes the property of Blue Energy Solar.

Exclusions and Limitations

The Limited Warranty does not apply to any of the following:

(a) PV Modules subjected to: misuse, abuse, neglect or accident; alteration, improper installation, application or removal (including but not limited to installation, application or removal by any party other than Blue Energy Solar, a Blue Energy Solar authorized dealer or technician approved by Blue Energy Solar in writing); non-observance of the applicable Blue Energy Solar installation, users and/or maintenance instructions or non-compliance with national and local electric codes; repair or modifications by someone other than an approved service technician of Blue Energy Solar; conditions exceeding the voltage, wind, or snow load specifications; power failure surges, lightning, flood, or fire; damage from persons, insects, animals, or industrial chemical exposure; glass breakage from impact or other events outside Blue Energy Solar’s control.

(b) Cosmetic effects stemming from normal wear and tear of PV Module materials or other cosmetic variations which do not cause power output lower than what is guaranteed by the Limited Warranty. Normal wear and tear of PV Module materials can include, but is not limited to, fading of frame color, weathering of glass coatings, and areas of discoloration around or over individual solar cells or any part of the PV Module.

(c) PV Modules installed in locations which, in Blue Energy Solar’s absolute judgment, may be subject to direct contact with bodies of salt water.

(d) PV Modules for which the labels containing product type or serial number have been altered, removed, or made illegible.

(e) PV Modules which have been moved from their original installation location without the express written approval of Blue Energy Solar.

Blue Energy Solar shall not be held responsible or liable to the customer or any third party arising out of any non-performance or delay in performance of any terms and conditions of sale, including this Limited Warranty, due to acts of God, war, riots, strikes, fire, flood, or any other cause or circumstance beyond the reasonable control of Blue Energy Solar.

Limitations of Warranty Scope

Subject to the limitations under applicable law, the Limited Warranty set forth herein is expressly in lieu of and excludes all other express or implied warranties, including but not limited to warranties of merchantability and of fitness for a particular purpose, use, or application, and all other obligations or liabilities on the part of Blue Energy Solar, unless such other warranties, obligations, or liabilities are expressly agreed to in writing, signed, and approved by Blue Energy Solar.

Blue Energy Solar shall have no responsibility or liability whatsoever for damage or injury to persons or property or for other loss or injury resulting from any cause whatsoever arising out of or related to the PV Modules, including, without limitation, any defects in the PV Module, or from use or installation. Under no circumstances shall Blue Energy Solar be liable for incidental, consequential, or special damages, howsoever caused. Loss of use, loss of profits, loss of production, and loss of revenues are therefore specifically but without limitation excluded.

Blue Energy Solar’s aggregate liability, if any, in damages or otherwise, shall not exceed the purchase price paid to Blue Energy Solar by the customer for the unit of product or service furnished or to be furnished, as the case may be, which gave rise to the warranty claim.

Some jurisdictions do not allow limitations on implied warranties or the exclusion of damages, so the above limitations or exclusions may not apply to you. If any provision of this Limited Warranty is held unenforceable or illegal by a court or other body of competent jurisdiction, such provision shall be modified to the minimum extent required such that the rest of this Limited Warranty will continue in full force and effect.

Obtaining Warranty Performance

If you believe you have a valid claim under this Limited Warranty, immediately notify:
(a) the seller and installer of the PV Modules,
(b) any authorized Blue Energy Solar installer, or
(c) contact Blue Energy Solar directly at the provided contact details.

Your installer or Blue Energy Solar will provide guidance on handling the claim, which shall include, but is not limited to, the provision of:

  • The warranty card, online warranty registration information, or invoice,
  • Evidence of the date of delivery of the PV Module,
  • Serial number and product number of affected modules,
  • Evidence supporting the claim.

Important Conditions:

  • The return of any PV Modules will not be accepted without prior written authorization from Blue Energy Solar.
  • Any goods supplied by the company shall be subject to the manufacturer’s warranty.
  • The only entitlement under this warranty is to have Blue Energy Solar enforce the manufacturer’s warranty on your behalf.

Warranty Nullification Conditions:
The warranty will be immediately void if:

  • The product is not used in accordance with the manufacturer’s instructions and specifications.
  • The product has been subjected to physical damage, abuse, misuse, alteration, neglect, tampering, improper maintenance, or unauthorized repairs or installations.
  • The product is not returned with an invoice or verifiable proof of purchase.

Handling Fees for Returns:

  • 1–7 days: 15% handling fee
  • 8–14 days: 45% handling fee
  • 15–21 days: 55% handling fee
  • Installation and labor costs are non-refundable.

Sales Terms, Conditions, and Policies

By placing an order with Blue Energy Solar, you agree to our sales terms, conditions, and policies.

Returns and Refunds

  • The Buyer acknowledges that Blue Energy Solar is not the manufacturer of the Goods.
  • All Goods are ordered from third-party manufacturers and are subject to the Manufacturer’s Specifications.
  • Blue Energy Solar makes no representations regarding manufacturer specifications.

Installations

  1. Installation Requirements:
    • Goods intended for electrical installation must be installed by qualified electricians or certified electrical installers.
    • The Buyer is responsible for ensuring compliance with all electrical legislation and regulations.
    • An Electrical Certificate of Compliance (COC) must be provided for completed installations.
  2. Return Requirements:
    The following must be submitted when booking a return:

    • Completed RMA documents after consultation with a technical advisor.
    • Pictures of the installation, clearly showing surge protection devices.
    • COC for the completed installation.
    • Line diagrams of the installation.
  3. Incorrect Installation & Testing:
    • If Phase One Testing and/or Phase Two Testing reveals damage caused by incorrect installation, misuse, or Buyer error, the Supplier will not accept returns, issue refunds, or provide replacements.
    • A 15% inspection/handling fee will be charged.
    • If the Buyer fails to collect rejected Goods within one calendar month after notification, a storage fee will apply.
    • If the Buyer requests repair or replacement due to their own incorrect installation or misuse, this will be subject to a new quotation and order at additional cost.

Returning Goods (Non-Defective Products)

  • If the Buyer wishes to return Goods that are not faulty but no longer wanted:
    1. Notify Blue Energy Solar in writing within 10 Business Days at [email protected]
    2. Return the Goods within 10 Business Days of delivery, between 9:00 AM and 4:00 PM, at the Buyer’s own cost and risk.
    3. The Goods must be correctly packaged in their original packaging with the unique return order number.
  • Upon receipt, the Supplier’s Technical Team will inspect the returned Goods. If they meet the return conditions, either a credit note or a refund will be processed accordingly.
